to the user or viewer of backcountrysecrets.com.

Backcountry Secrets provides you with access to find and locate locations to participate
in backcountry sports. A members only section allows you to share locations, review
the locations, and post images. All services, existing or future additions, are
subject to this Terms of Use.
Limits of Liability
We make no warranties or representations of any kind that the services provided
by this website or any linked site will be uninterrupted, error-free, or that the
site or the server that hosts the site are free from viruses or other forms of harmful
computer code. All such information is provided "as is", and with specific disclaimer
of any warranties of merchantability, fitness for a particular purpose, title, or
non-infringement. In no event shall we, our agents, or anyone else who has been
involved in the creation, production, or delivery of these pages, be liable for
any direct, incidental, or consequential damages resulting from the use of this
website or any linked site.
Acceptance of Agreement.
You agree to the terms and conditions outlined in this Terms of Use Agreement ("Agreement")
with respect to backcountrysecrets.com (the "Site"). This Agreement constitutes
the entire and only agreement between us and you, and supersedes all prior or contemporaneous
agreements, representations, warranties and understandings with respect to the Site,
the content, products or services provided by or through the Site, and the subject
matter of this Agreement. This Agreement may be amended at any time by us from time

Content and Activity Prohibited

- includes a photograph of another person that you have posted without that person's

on or through our site. We reserve the right to investigate and take appropriate
legal action against anyone who, in our sole discretion, violates this provision,
including without limitation, removing the offending activity or reporting you to
the appropriate law enforcement agencies. Prohibited activity includes, but is not
limited to activity that, in our sole discretion:
- criminal activity, including child pornography, gambling, fraud, trafficking in
obscene material, drugs, harassment, spamming, linking to viruses or other harmful
files, copyright infringement, patent infringement, or theft of trade secrets;
- advertising or solicitation to any Member to buy or sell any products or services
through the site.
- covering or obscuring the banner advertisements on your shared points via HTML/CSS,
code, or any other means;
- interfering with, disrupting, or creating any undue burden on the site or the networks
or services connected to the site by use of any robot, spider or any other automated
means to access the site for any purpose without written permission from us.
- attempting to impersonate any other person;
- using another members account, username, or password or disclosing your username,
account, or password to a third party;
- using the site to break any rules, laws or regulations;
Member Disputes
You are solely responsible for your interactions with other Backcounty Secrets members.
We reserve the right, but have no obligation, to monitor disputes between you and
other members.
Site Copyright
The backcountry secrets, reviews, point locations, descriptions, organization, graphics,
design, compilation, and other materials of this Site are protected under applicable
copyrights, trademarks and other proprietary rights. Copying, redistribution, use,
or publication by you of any part or item of the Site, except as allowed this agreement,
is strictly prohibited. You do not acquire ownership rights to any content, document,
or other materials on this Site by using the Site. The posting of information, backcountry
secrets, reviews, point locations, descriptions, or any other materials on the Site
does not constitute a waiver of any right. Some content on the site is the copyrighted
work of third parties and our members. If you wish to use such materials, it is
your responsibility to contact the aforementioned parties or members.
Copyright Infrigement Claims & Notification
Backcountry Secrets understands the effort put into copyrighted material. We expect
and rely on our users to bring copyright infringements to our attention. If you
believe that your work has been used on our site in such a manner that violates
a copyright, please notify us and send us:
- Your contact information, including: telephone number, address, and e-mail address.
- Information that will allow us to appropriately identify the copyrighted material
that has been infringed upon.
- Information about what in the material is being infringed and needs action. Such
information may include, but is not limited to a backcountry secret's name, id,
and web address.
- A signature and statement that the above information is complete and accurate to
the best of your knowledge; that you have good faith belief that the infringed material
identified is not authorized by the copyright owner, its agent, or the law; and
under penalty of perjury, that you have proper authority to act in behalf of the
copyright owner or are the copyright owner.

Indemnity
You agree to indemnify and hold Backcountry Secrets, its subsidiaries, and affiliates,
and their respective officers, agents, partners and employees, harmless from any
loss, liability, claim, or demand, including attorneys' fees, made by any third
party due to or arising out of your use of the site in violation of this agreement
and/or arising from a breach of this agreement and/or any breach of your representations
and warranties set forth above and/or if any content that you post on the site causes
Backcountry Secrets to be liable to another.
Miscellaneous
This agreement consitutes the entire agreement between you and Backcountry Secrets
with respect to our site, and superseeds all other communications and/or proposals
between you and us regarding our site.
